Member Terms & Conditions and Professional Standards

These Terms govern approved Professional, Pro, and Office members who use the My Tax Pros Networking member portal, directory, referrals, leads, Academy, Marketplace, and related services.

Important legal review notice

This operational standard is based on the official IRS and FTC materials linked below. It is not legal advice. My Tax Pros should have qualified counsel review the final entity name, billing terms, state-law provisions, liability language, privacy terms, and enforcement process before relying on it as the final production contract.

1. Agreement and electronic acceptance

These Member Terms & Conditions and Professional Standards (Terms) form a binding agreement between you and My Tax Pros Networking (My Tax Pros) when you check the acceptance boxes and select Accept and enter member portal. If you do not agree, do not accept or use the approved-member features.

Your electronic acceptance records your account, the approved application, the Terms version, a document fingerprint, and the server time. You may download or print a copy for your records.

2. Eligibility, approval, and accurate information

Approved-member access is available only to a person or organization with an eligible paid membership, an application approved by My Tax Pros, and acceptance of the current Terms. Approval may be conditioned on identity, credential, payment, or professional-status verification.

You must keep account, profile, credential, business, and contact information accurate and current. You must promptly tell My Tax Pros if a credential expires, is suspended or revoked, or if a disciplinary, criminal, preparer-status, data-security, or other material professional matter arises.

3. Independent professional relationship

My Tax Pros operates a professional network and technology platform. It is not the Internal Revenue Service, a government agency, your employer, your law firm, your accounting firm, or the tax return preparer for your clients. Approval, directory placement, a badge, a referral, or a lead does not create an employment, agency, partnership, joint venture, fiduciary, or franchise relationship.

You independently decide whether to accept a client engagement and remain solely responsible for engagement terms, fees, scope, tax advice, return preparation, filings, signatures, client communications, professional judgment, and compliance with federal, state, local, licensing, and ethical requirements.

4. PTIN, EFIN, credentials, and authorization

You must obtain and maintain every registration, identifier, license, authorization, insurance policy, and credential required for the work you perform. A person who prepares all or substantially all of a federal tax return or refund claim for compensation generally must have a current IRS Preparer Tax Identification Number (PTIN). Electronic filing may also require an Electronic Filing Identification Number (EFIN) for the individual or firm, as applicable.

PTINs are individual identifiers and must not be shared. You may not state or imply that a PTIN, EFIN, Annual Filing Season Program Record of Completion, enrolled-agent status, professional license, My Tax Pros approval, or platform badge is an IRS endorsement or a guarantee of skill or results.

5. Professional conduct and practice before the IRS

When Circular 230 applies to your conduct or practice before the IRS, you must follow its current requirements, including applicable duties of competence, diligence, candor, conflict management, written-advice standards, fee rules, and restrictions on disreputable conduct. Other members must meet the professional and ethical standards that apply to their role and services.

You must not make false, misleading, coercive, deceptive, or unsubstantiated claims; impersonate another person; misuse another professional's credentials; promise a refund or outcome; or assist conduct you know is fraudulent or unlawful.

6. Return accuracy, due diligence, Form 8867, and records

You are responsible for applying the tax law, asking reasonable follow-up questions, resolving incomplete, inconsistent, or incorrect information, and satisfying all paid-preparer due-diligence requirements that apply to a return or claim.

When required, you must complete and submit Form 8867 for the Earned Income Tax Credit, Child Tax Credit or Additional Child Tax Credit or Credit for Other Dependents, American Opportunity Tax Credit, and head-of-household filing status. You must retain the required due-diligence records for the period set by current law and IRS guidance, which is generally three years for the records described in the Form 8867 instructions. Other retention duties may require longer periods.

7. Taxpayer information, confidentiality, and IRC Sections 7216 and 6713

You must protect taxpayer and client information and may use or disclose tax return information only as permitted by law. When a use or disclosure requires the taxpayer's informed written consent, you must obtain a consent that satisfies current Treasury Regulations and IRS guidance before the use or disclosure.

You must not use a platform lead, referral, message, profile, or contact request to obtain, sell, disclose, or exploit tax return information improperly. Violations may result in civil or criminal penalties, platform suspension, reporting where legally required, and termination.

8. No taxpayer records on My Tax Pros

Do not upload, paste, transmit, or request taxpayer Social Security numbers, Individual Taxpayer Identification Numbers, full dates of birth, tax returns, tax transcripts, W-2s, 1099s, identity documents, banking or payment-card details, source documents, authentication codes, or similar sensitive taxpayer information anywhere on My Tax Pros.

Use your own lawfully configured, access-controlled, secure client system for taxpayer records and document exchange. If sensitive data is submitted accidentally, stop using the affected workflow, do not redistribute it, and notify My Tax Pros support promptly so the incident can be handled.

9. Data security, written security plan, and incident response

You must maintain safeguards appropriate to the size, complexity, activities, and information handled by your practice. If the FTC Safeguards Rule applies, your program must include a written information-security program overseen by a qualified individual, a documented risk assessment, appropriate administrative, technical, and physical safeguards, workforce training, service-provider oversight, testing or monitoring, and an incident-response plan.

Use multi-factor authentication, encryption, secure backups, device and access controls, software updates, phishing defenses, and secure disposal when required by law or reasonably necessary for the risk. Tax professionals should maintain the written information security plan described by current IRS and FTC guidance.

You must investigate and respond to security incidents and make legally required notices, including any notice to the FTC or affected persons. Notify My Tax Pros promptly of an incident that affects platform credentials, platform data, a platform lead, or another user.

10. Leads, referrals, and contact requests

A lead or referral is an opportunity to evaluate, not a guaranteed client, engagement, payment, tax result, or revenue outcome. Availability, matching, placement, and response timing may vary by plan, location, service, member standing, and consumer choice.

Use contact information only to respond to the relevant request or for another lawful purpose authorized by the individual. Do not resell leads, scrape records, send unlawful marketing, pressure a consumer, misrepresent a match, or share a request with an unauthorized person. Follow applicable telemarketing, email, text-message, privacy, and professional-solicitation rules.

11. Profiles, directory publication, and badges

Your approved profile begins as a draft and becomes public only when the applicable platform controls permit publication. You grant My Tax Pros a non-exclusive license to display the profile content, business marks, and images you submit for platform operation and promotion of your directory listing.

A verified or plan badge means only that My Tax Pros completed the platform review represented by that badge at the relevant time. It is not government approval, IRS endorsement, a background-check guarantee, a promise of continuing good standing, or a guarantee of work quality. My Tax Pros may correct, hide, or remove inaccurate or noncompliant content.

12. Membership, billing, renewal, and plan benefits

Plan price, billing interval, included features, renewal terms, taxes, and any trial or promotion are disclosed at purchase. Paid plans may renew automatically until canceled through the available billing controls or support process. Cancellation stops future renewal but does not erase charges already incurred, subject to applicable law and any written refund term presented at purchase.

Access to plan features depends on successful payment, member standing, application approval, current Terms acceptance, and feature availability. Included leads, priority placement, visibility, Academy access, support level, and other benefits are subject to the limits stated for the plan and do not guarantee clients, revenue, rankings, examination outcomes, credentials, or tax results.

13. Academy, resources, and educational content

Academy courses, blog posts, templates, updates, and resource links are general educational and operational materials. They are not individualized legal, tax, accounting, cybersecurity, insurance, or investment advice and do not replace your professional judgment or current primary authority.

A course provides continuing-education credit only when My Tax Pros expressly identifies the credit, provider, jurisdiction, eligibility conditions, and completion requirements. You are responsible for confirming that a program satisfies your own credential or licensing obligations.

14. Marketplace and partner services

Marketplace products and partner services may be supplied by independent providers under separate terms. Review the provider, price, scope, privacy practices, security controls, and contract before purchase. My Tax Pros does not become the provider merely by listing, routing, or facilitating access to an offer.

Do not send taxpayer records through a Marketplace inquiry or partner-contact form. A provider must receive sensitive information only through a separate lawful and secure process appropriate to the service.

15. Acceptable use

You may use the platform only for lawful professional and business purposes. You may not compromise security; bypass access, plan, approval, or verification controls; probe or scrape the service; introduce malicious code; interfere with another user; harvest personal information; create deceptive accounts; infringe rights; post unlawful or harmful content; or use the platform to facilitate tax fraud, identity theft, money laundering, sanctions evasion, or other misconduct.

Keep credentials confidential, use multi-factor authentication where offered or required, and notify support promptly of suspected account compromise. You are responsible for activity under your account except to the extent caused by My Tax Pros.

16. Intellectual property

The platform, software, design, My Tax Pros marks, and platform-created content are owned by or licensed to My Tax Pros and are protected by applicable law. Your membership gives you a limited, revocable, non-transferable right to use member materials for your own authorized professional activity, subject to any resource-specific license.

You retain ownership of content you lawfully submit. You represent that you have the rights and permissions needed to submit and display it and that it does not violate privacy, publicity, confidentiality, trademark, copyright, or other rights.

17. Monitoring, suspension, and termination

My Tax Pros may review platform activity and take proportionate action to protect users, enforce these Terms, comply with law, or respond to security, payment, credential, professional-conduct, or reputational risk. Action may include requesting information, limiting a feature, unpublishing a profile, removing a badge, suspending access, preserving evidence, or terminating membership.

When reasonably possible, My Tax Pros will provide notice and an opportunity to respond. Immediate action may be taken when needed to protect a person, data, the platform, or legal compliance. Obligations concerning confidentiality, security, records, intellectual property, payments already due, disclaimers, and liability survive termination where applicable.

18. Disclaimers and limitation of liability

To the fullest extent permitted by law, the platform is provided as available without a promise that it will be uninterrupted, error-free, or suitable for every practice. My Tax Pros does not guarantee any member, consumer, partner, lead, referral, course, resource, tax outcome, revenue result, credential, or third-party service.

To the fullest extent permitted by law, My Tax Pros will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from platform use, third-party conduct, professional services, or a user's violation of law. Any limitation is subject to rights and remedies that cannot lawfully be waived.

19. Responsibility for claims

You are responsible for claims, losses, penalties, and reasonable costs caused by your professional services, unlawful conduct, breach of these Terms, inaccurate representations, mishandling of taxpayer information, infringement, or violation of another person's rights. To the extent permitted by law, you agree to defend and indemnify My Tax Pros and its personnel from third-party claims arising from those acts or omissions, except to the extent caused by their own misconduct.

20. Changes, governing law, and contact

My Tax Pros may update these Terms to reflect legal, security, product, or operational changes. A material update may require you to review and accept a new version before approved-member access continues. The version and effective date appear above.

These Terms are governed by Florida law, except where federal law or another mandatory law controls. If part of these Terms is unenforceable, the remaining provisions continue to apply. A waiver must be written and applies only to the specific instance.

Questions, compliance notices, and security reports may be sent to tax@mytaxpros.net. Do not include taxpayer records or sensitive taxpayer information in the message.
